Catholic ceremonies
If you are spanish citizen or you have spanish residency:
You will need to do some paperwork:
- Official Baptismal Certificate given in the parish you have been baptised. (If it is not given in the original church the certificate needs to be legalized by the origin Archbishopric. This certificate must not be older than 6 months)
- Birth certificate (Civil Register) with the number and folio of the Registry book (or Family book of the parents)
- ID: Identification Documents of the Bride and Groom
- Certificate of Marriage Guidance Preparation Course (essential, you can ask in your parish)
- The couple must go to the Bride or Groom parish with all the documents to begin the Marriage File. Each one of you need to go with a witness, someone you know for a long time, it cannot be a relative.
- Once the Marriage File is finished, and through the archbishopric of both countries, the Marriage File will be sent to the Spanish Parish you have chosen to celebrate the wedding.
- Once you celebrate the wedding, you will get a document (COMUNICACION DE MATRIMONIO CANONICO CONTRAIDO) you will need to take this to the Spanish Civil Register to register it.
If you are non spanish citizens (and do not have spanish residency) and both of you are catholic:
You should go to your parish, in your country, and tell them you want to start your Marriage File explaining the parish and city in Spain, in which you would like to celebrate the wedding (it is important you ask for available dates in the parish you wish to get married). You will need to do some paperwork that your Priest will explain to you (it can change depending on the Country): It is a very simple procedure and we can help you.
Civil Ceremony:
For civil marriage in Spain it is necessary Spanish Residence for more than two years.
The first thing to do is to choose the Town Hall, Court or place you would like to celebrate the ceremony.
A very good option, is to have the ceremony in the same place that you will celebrate your wedding. Contact us and we will explain how to do it.
Documents:
- You need to go to the Court where you will get married and complete the forms for marriage.
- Declaration of civil state of both Bride and Groom
- You need to take: ID fotocopy / Birth certificate / Residency certificate of the last two years (this certificate must not be older than three months)
Non Spanish citizens:
- Certification of consular inscription, with declaration of the address, time of residence in Spain and place of origin.
- It is necessary to have resided in Spain at least two years. Certificate emitted by the City council corresponding to the residence.
- You need to check if the personal law of your country demands something else when contracting civil marriage in Spain.
- In some cases you will have to contribute Certificate of Married Capacity.
According to the country of origin and if the legal requirements are not fulfilled in order to be able to contract civil marriage in Spain, you can get legally marriage in your country (just like a proceeding to formalize the union, without celebration) and still have a blessing ceremony to make in Spain, without legal importance but with all the requirements of celebration and reception with all the guests.
Divorcés or with previous cancellation:
- Judgments of divorce dictated out of Spain: Exequatur of the same ones (confirmation Room 1 ª of the Supreme Court)
- literal Certification of the previous marriage, with marginal annotation of DIVORCE or NULLITY
Widowers:
- Literal Certification of the previous Marriage
- Literal Certification of Death of the previous deceased spouse
Minors:
- If they are over 16 years of age in the literal certification of Birth marginal note of emancipation must consist
- If they are over 14 years of age and under 16 years of age they must obtain before the judicial dispensation.
Sheltered, refugee politicians or asylum seekers or refuge:
- Certificate of the Headquarter of the Police, or of the A.C.N.U.R., or of the Red Spanish Cross, or of another Competent, supporting Organisation of his condition of such, with the personal information of the interested parts.
